Welcome to RADICAL COMPUTER TECHNOLOGIES LLC. The following are our Terms of Use, which apply to your use of the other products, services, and software we provide (collectively, the "Services"). "We," "our," or "us" refer to RADICAL COMPUTER TECHNOLOGIES LLC and its subsidiaries. Using RADICAL COMPUTER TECHNOLOGIES LLC's products constitutes your agreement to these Terms, our Privacy Policy, Community Guidelines, and other policies we publish. Please read these Terms carefully.

These Terms contain an arbitration clause and a class action waiver, which affect your rights regarding dispute resolution. Arbitration and the dispute resolution mechanism are explained in detail below, along with how you can opt out of arbitration.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services. Except for user-provided content, we own and retain all rights, title, and interest in and to the Services. These Terms do not grant you any rights to our graphical user interface, trademarks, or service marks. Any feedback, comments, or suggestions you provide regarding the Services are voluntary, unsolicited, and without restriction, and we may use such feedback, comments, or suggestions at our sole discretion without any obligation to you.

You are responsible for your use of the Services and for any information, data, text, images, stickers, usernames, graphics, photos, profiles, music, audio, video, links, or other materials ("Content") that you create, edit, publish, store, and share using the application, including compliance with applicable laws, rules, and regulations. You hereby acknowledge and agree that your use of the tools, features, and functionalities provided by the Services is with your consent and at your own discretion, subject to these Terms, the Privacy Policy, Community Guidelines, and any other applicable terms or policies.

Service Content

You understand that using the Services may expose you to content that is offensive, harmful, inaccurate, or otherwise inappropriate. All shared content is the sole responsibility of the person who shares it. While we prohibit certain behaviors and content on the Services, we may not monitor or control all content shared through the Services and therefore are not responsible for such content.

We reserve the right to remove content that violates these Terms or our Community Guidelines, including content that infringes copyright, trademark, or other intellectual property rights, explicit pornographic content, or content we deem inappropriate at our sole discretion.

Rights Granted in Your Content

We do not claim any ownership of your Content unless it incorporates Company Content.

You grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to allow our application to use your Content for any purpose related to the Services and our business, including hosting, copying, distributing, creating derivative works, displaying, and performing your Content (subject to any privacy settings you apply), including for promoting and redistributing part or all of the Services. This license is perpetual and authorizes us to make your Content available to other users on the Services after you share it.

Our application's mission is to empower visual storytellers. To achieve this mission, we encourage creators to share and build upon each other's ideas and works. We sometimes refer to this as "remixing" others' work. This inspires new masterpieces, allowing you to create entirely new works without starting from scratch!

Our Application

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to copy, display, and perform content owned by us or our licensors, but only for your personal and non-commercial use and only as permitted by the functionality of the Services.

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to copy, display, perform, and create derivative works of our application's Content that is identified within the Services as available for commercial use ("Commercial Use Our Application Content"), and you may distribute derivative works incorporating Commercial Use Our Application Content for any purpose, including commercial purposes, but only as permitted by the functionality of the Services.

Limitation of Liability

To the maximum extent permitted by applicable law, our application, its affiliates, licensors, sponsors, officers, directors, employees, and agents ("Our Application Parties") shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues (whether incurred directly or indirectly), or any loss of data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services, including without limitation any defamatory, offensive, or illegal conduct of other users or third parties; (iii) any content obtained from or generated by the Services. The limitations in this subsection apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence), or otherwise, and whether or not the Our Application Parties have been informed of the possibility of any such damage, even if a remedy set forth herein is found to have failed of its essential purpose.

Changes to Terms

We may modify these Terms at any time. If we make any material changes, we will notify you in the manner described in the "Notices" section above; your continued use of the Services thereafter constitutes your acceptance of the changes. If you object to any changes, your sole remedy is to terminate your our application account and stop using the Services.
